DONELON v. ALTMAN, NO. C-713794-22 (19TH Judicial Dist. Ct.)
On September 11, 2020, James J. Donelon, acting in his Official Capacity as Commissioner of Insurance of the State of Louisiana, filed a Complaint for Declaratory Relief and Permanent Injunction in the United States District Court for the Middle District of Louisiana, naming the Statutory Rehabilitator of SHIP as a Defendant. On September 15, 2021, the United States District Court for the Middle District of Louisiana dismissed the Complaint without prejudice for lack of jurisdiction. On December 3, 2021, Commissioner Donelon and the Louisiana Department of Insurance filed a new Complaint together with motions seeking temporary relief in the Nineteenth Judicial District Court, Parish of East Baton Rouge, Louisiana. That proceeding remains pending. Docket entries in both cases are posted below.
